In de afgelopen tijd is compensatoir toetsen in het Nederlandse onderwijs een populaire toetsvorm geworden. Hierbij slaagt een student voor een reeks toetsen indien het gemiddelde op deze reeks voldoende is. In deze analyse betogen wij dat het compensatoire systeem echter zowel onverdedigbaar als moreel gezien onverantwoordelijk is. Het grote gevaar van compensatoire toetsregimes is namelijk dat het hiaten in kennis en vaardigheden tolereert, wat de validiteit van een diploma ondermijnt en bovendien medeburgers in gevaar brengt.

Like other aspiring geologists in the 1830s, Darwin focused heavily on the rising and falling of the earth's crust. I use his time in the Andes to underscore the importance he placed on larger questions of vertical movement, which mountains helped to solidify in his mind. His most impressive ramblings occurred in 1835 on two high passes in the Andes. Prior to his upland journey, he was well prepared to see the gradual movement of the earth's crust, but his time (...) in the mountains honed his vertical vision. His actual travels up and over enabled him to think more clearly about rise and fall, and how corresponding geographies could link the past to the present. Mountains were instructive backdrops to his theorizing, partly because he traveled through them, but also because his time there, linked with other geographies, became a means to foster his thinking both spatially and temporally. He did not think about mountains, but with them and through them. He is a good example of the broader vertical consciousness that directed many sciences at this time. (shrink)

This article examines the variety of men's responses to feminism in late nineteenthand early twentieth-century United States through texts that addressed the claims raised by the turn-of-the-century women's movements. Antifeminist texts relied on traditional arguments, as well as Social Darwinist and natural law notions, to reassert the patriarchal family and to oppose women's suffrage and participation in the public sphere. Masculinist texts sought to combat the purported feminization of American manhood by proposing islands of masculinity, untainted by feminizing forces; proscribed (...) homosociality was also cast as an effective antidote to homosexuality. Profeminist texts openly embraced women's claims for changes in public participation and private and family life, both out of a sense of justice and the conviction that such changes would benefit men and challenge the emerging industrial capitalist order. Parallels to contemporary men's responses to the women's movement are suggested. (shrink)

This essay argues that a Christian incarnational response to posthumanism must recognize that what is at stake isn't just whether belief systems align. It seeks to relocate the interaction between the church and posthumanism to how the practices of posthumanism and Christianity perform the bodies, affections and dispositions of each. Posthuman practices seeks to habituate: (1) A preference for informational patterns over material instantiation; (2) that consciousness and the self are extended and displaced rather than discrete and localized; (3) that (...) the body is merely a tool, the original prosthesis we learn to manipulate and (4) that human life is organized such that it is seamless with intelligent machines. The Christian performance of embodied life, on the other hand, has Christ as template and, in the Eucharist, Christians are marked by offering, sacrifice and celebration in a community that affirms the integrity of our common incarnate life. This article explores the relationships between legal proof and fundamental epistemic concepts such as knowledge and justification. A survey of the legal literature reveals a confusing array of seemingly inconsistent proposals and presuppositions regarding these relationships. This article makes two contributions. First, it reconciles a number of apparent inconsistencies and tensions in accounts of the epistemology of legal proof. Second, it argues that there is a deeper connection between knowledge and legal proof than is typically argued for or presupposed in (...) the legal literature. This connection is illustrated through a discussion of the Gettier problem in epistemology. It is argued that the gap or disconnect between truth and justification that undermines knowledge in Gettier cases also potentially undermines the success of legal verdicts. (shrink)

Maar niet alle vormen van whataboutism impliceren echter een drogredenering, noch worden ze altijd verkeerd toegepast. In Nederland worden al geruime tijd zowel op landelijk als op lokaal niveau en zowel vanuit het beleid als door bezorgde ouders uiteenlopende inspanningen geleverd om onderwijssegregatie tegen te gaan. In dit artikel wordt betoogd dat we desondanks voor een zware opgave staan, aangezien het uitoefenen van individuele vrijheid en het streven naar sociale gelijkheid voor spanningen kan zorgen. In het artikel wordt de stelling uitgewerkt dat sociale integratie in het onderwijs via gemengde scholen niet per se de enige en (...) beste manier is om het ideaal van gelijke kansen te realiseren. Verder stellen we dat een onderscheid moet worden gemaakt tussen vrijwillige en onvrijwillige vormen van onderwijssegregatie. The advantages of adopting a realist semantics within linguistics are seen as: first, such semantics can allow for meaningful disagreements between speakers; and second, such semantics minimizes indeterminacy. These two advantages are translated into comparable advantages for such semantics if used in law. Three different versions of realist semantics are distinguished within recent legal theory. Only one of these is deemed capable of delivering the advantages of a truly realist semantics. Although a broad applicability of realist semantics is defended—to cover (...) terms referring to functional and moral as well as natural kinds—a limited role for realist semantics within legal interpretation is defended. Such semantics may provide the first word in legal interpretation; it never provides the last word. The application of realist semantics to law itself is finally assayed. The ancient philosophers aimed to turn us away from thinking about particularizing affection to thinking about justifiable human relations. The aim of their protreptic discourses was to get their readers, who were citizens, sons, and fathers, to think about their lives by putting these relations into question. I show how this conversion works and explore its political consequences by reading the accounts of friendship in Plato, Aristotle, and Cicero, and then comparing those accounts with the views on the causes and (...) justifications of human relations of Rousseau, of Christians and post-Christian Kantians, and of the Hebrew Bible and its Rabbinic commentators. Contrasting traditional and common forms of ethics consultation with bioethics mediation, I describe the case of a “second opinion” consultation in the care of a patient with advanced cancer for whom treatment was futile. While the initial ethics consultation, performed by a colleague, led to a recommendation that some may deem ethical, the process failed to involve key stakeholders and failed to explore the underlying values and reasons for the opinions voiced by various stakeholders. HahnAmong the thornier issues surrounding the Parisian Franciscan collaborative compilation Summa Halensis1 is the matter of its sources, consideration of which most often involves discernment of its contributing authors and their engagement with near-contemporary texts and trends in twelfth- and thirteenth-century scholastic theology.2 Hiding in plain sight, and thus easily (...) overlooked in this array of detailed concerns, is the privileged place afforded to Augustine of Hippo—and more precisely, to historically underexamined and underutilized of his works—within certain sections of the Franciscan Summa, a dynamic that seems to indicate a deliberate Augustinian ressourcement alongside more standard scholastic uses of stock textual auctoritates.3 [End Page 59]In order to establish the plausibility and general contours of such ressourcement, the present study examines the deployment of Augustine's Contra Faustum and De spiritu et littera in the Franciscan Summa's treatise on law, outlining both the originality and significance of this usage. The study falls into three main parts. In the first part, I offer a brief introduction to these two works, noting their import vis-à-vis Augustine's broader corpus. In the second, I provide a rough sketch of their respective reception histories, limning the standards of use that obtain in twelfth- and thirteenth-century scholastic writings prior to the Franciscan Summa. And in the third part, I detail the employment of these two works in the Summa itself, attending to where and how they are used, and how this usage variously coheres with and moves beyond the preceding theological tradition. Finally, by way of conclusion, I gesture at the immediate impact of this usage, taking as my primary example the later Summa theologiae of Thomas Aquinas. As I aim to show, although these important Augustinian works were not entirely unknown in the twelfth and early thirteenth centuries, there is little evidence of their first-hand utilization in scholastic theology prior to that of the Summa Halensis. Moreover, the Franciscan Summa's ample and markedly astute use of these works can be seen not only to undergird the Augustinian cast of its teaching on the distinction and relation of law and grace, but also to initiate and direct a broader return to these sources among the next generation of mendicant scholastics, Franciscan and Dominican alike.I. Why celebrate Thomas Aquinas? Three eras that celebrated Aquinas in unique ways—the Fourteenth century that canonized him, the Sixteenth century that declared him a doctor of the Church, and the nineteenth century that made him patron of the schools—all struggled with the corrosive effects of nominalism and voluntarism on Western culture. With the help of G. K. Chesterton and C. S. Lewis, this essay suggests that these eras were drawn to Aquinas because his theology offers an antidote against these twin (...) diseases. Specifically, Thomas Aquinas's theology can help us confront the ills of nominalism and voluntarism by encouraging us to celebrate nature, grace, and Christian apprenticeship in virtue as the perennial gifts of God's love. IntroductionI often begin writing for personal reasons: to slow my thinking, clarify and organize my thoughts, trace ideas, and sort concepts. Generally, a concern for something I consider wrong about the world motivates me to write. Provoked by such a concern, I write to understand why and how what is wrong came to be that way and why and how I (...) think it can or should be different. I write in reply to H. Richard Niebuhr's moral hermeneutic question, "What's going on?" And yet, while writing typically begins (for me) as a personal search for understanding, this search eventually leads me to (re) discover my formative communities of inquiry and interpretation. None of my questions or ideas, none of my orienting values, none of my interpretive impulses are mine alone. They do not, and cannot, exist independently of others' questions, ideas, values, and interpretations. To use Peirce's metaphor, they are slender fibers braided into a larger cable rather than independent links in a chain. The issues and questions that motivate my research; the topics I care about enough to develop into articles and books; the conceptual, critical, and normative vocabularies I bring to my research and writing; the intellectual traditions that shape the patterns of my thinking—none of these are strictly personal or individual. They have taken root and grown in me as I've learned with and from others. Writing reminds me that, as a person, I am a creature of relational processes because it shows me that my mind is not (exclusively) my own—what and how I think have been formed, animated, and limited by my experience with others in a larger world of experience that is broader and deeper than any individual mind.I open this brief essay with this comment to acknowledge my gratitude and indebtedness not only to the authors of the articles in this special issue (Walter Gulick, Robert Smid, John Teehan, and AJ Turner) but also to the larger community of scholars that comprise the readership of the American Journal of Theology and Philosophy (AJTP) and the Institute for American Religious and Philosophical Thought (IARPT). I attended my first IARPT (HIARPT, at the time) conference about seventeen years ago, soon after completing my Ph.D. I didn't know anyone personally then, but I knew several folks as authors of articles and books I had read in recent years. I discovered IARPT through the bibliography of Victor Anderson's book, Pragmatic Theology: Negotiating [End Page 80] the Intersections of an American Philosophy of Religion and Public Theology. I resonated with Anderson's articulation of a socially engaged public theology that drew from American pragmatist, historicist, and naturalist philosophies of religion. His mind had been where mine was going, into the dissenting tradition of American immanence, or the left wing of American radical theology, as I refer to it.While reading Anderson's book, I learned that many of the authors in his bibliography met every summer as a (relatively?) organized group of like-minded scholars. I joined them the next chance I had. And as things go with this group, I was immediately recruited to serve as the book review editor for the AJTP! Since that first meeting, I've attended as many IARPT meetings as my schedule allows, organized one of the summer conferences, served as AJTP book review editor for several years, and then served for several more years as the AJTP editor (following Michael Raposa's illustrious term!). Most recently, I was honored when Andrew Irvine and Austin Roberts made American Immanence a focus of the 2021 IARPT conference, "Political Thought and the Powers of Democracy: American Thought in the Anthropocene." Gulick's, Smid's, Teehan's, and Turner's articles began as papers for that conference.All this is to say what I have heard many others say through the years: the IARPT/AJTP community of interpretation has become a primary intellectual (and even spiritual) home for me. At the outset of a critical examination of everyday greed, two basic challenges must be faced. First, there is a need for a clear and determinant enough understanding of greed to enable one to make a reliable assessment of its alleged strengths and weaknesses. This is particularly so when presented with claims by some that, suitably constrained, greed can be good. Does this mean that, at least to some extent, greed can be good as such? Or does it mean that, (...) even if greed at its best has fundamentally undesirable qualities, it can still sometimes serve as an acceptable means to good ends?Second, at the personal level, greed can enter our lives in ways that are morally troubling, if not corrupting. All of us have had some first-hand acquaintance with greed, either through being lured by its charms or through being harmed by the greed of others. Beginning in childhood, we are chided by others when it seems to them that we are being greedy. However, as adults we are sometimes chided for allegedly not seeing that in some contexts greed actually can be good. We may think that the greed of some is responsible for the impoverishment of others. However, some argue that, suitably constrained, greed is an essential feature of any economic system that holds out hope that even the least well off can prosper. Still, little is said about what constraints on greed might be needed, or about how they might best be obtained. Further, largely absent from this conversation is a substantive analysis of what greed is.This absence has not prevented the emergence of sweeping appraisals of greed. However, such appraisals need to be supported by more clarity about what greed is. A major aim of this chapter is to advance this end, not by offering the last word on how we should understand greed, but by presenting a solid basis from which we might gain greater clarity. In the multidisciplinary field of developmental cognitive neuroscience, statistical associations between levels of description play an increasingly important role. One example of such associations is the observation of correlations between relatively common gene variants and individual differences in behavior. It is perhaps surprising that such associations can be detected despite the remoteness of these levels of description, and the fact that behavior is the outcome of an extended developmental process involving interaction of the whole organism with a variable environment. Given (...) that they have been detected, how do such associations inform cognitive-level theories? To investigate this question, we employed a multiscale computational model of development, using a sample domain drawn from the field of language acquisition. The model comprised an artificial neural network model of past-tense acquisition trained using the backpropagation learning algorithm, extended to incorporate population modeling and genetic algorithms. It included five levels of description—four internal: genetic, network, neurocomputation, behavior; and one external: environment. Since the mechanistic assumptions of the model were known and its operation was relatively transparent, we could evaluate whether cross-level associations gave an accurate picture of causal processes. We established that associations could be detected between artificial genes and behavioral variation, even under polygenic assumptions of a many-to-one relationship between genes and neurocomputational parameters, and when an experience-dependent developmental process interceded between the action of genes and the emergence of behavior. We evaluated these associations with respect to their specificity, to their developmental stability, and to their replicability, as well as considering issues of missing heritability and gene–environment interactions. We argue that gene–behavior associations can inform cognitive theory with respect to effect size, specificity, and timing. The model demonstrates a means by which researchers can undertake multiscale modeling with respect to cognition and develop highly specific and complex hypotheses across multiple levels of description. The \CDM cosmological model is remarkable: with just six parameters it describes the evolution of the Universe from a very early time when all structures were quantum fluctuations on subatomic scales to the present, and it is consistent with a wealth of high-precision data, both laboratory measurements and astronomical observations. However, the foundation of \CDM involves physics beyond the standard model of particle physics: particle dark matter, dark energy and cosmic inflation. Until this ‘new physics’ is clarified, \CDM is at (...) best incomplete and at worst a phenomenological construct that accommodates the data. I discuss the path forward, which involves both discovery and disruption, some grand challenges and finally the limits of scientific cosmology. (shrink)

How is devotion (bhakti) related to knowledge (jñāna)? Does one lead to the other? Do they correspond to different paths for different people? Commentators on the Bhagavad-Gītā have debated these questions for centuries. In this essay I will suggest, as many Indian commentators have, that the paths of devotion and knowledge described in the Gītā can be harmonized. I will not draw from Indian texts, however, but from a suggestive parallel in the history of Chinese religions: namely, the development of (...) a tradition of “dual cultivation” of Pure Land and Chan 禪. I will focus in particular on the works of Yunqi Zhuhong 雲棲祩宏 (1535–1615) and his use of the distinction between principle (li 理) and phenomenon (shi 事) to reconcile seemingly divergent religious paths. I will conclude by considering the implications of this synthesis for nondualist interpretations of the Gītā. (shrink)

John Martin Fischer's The Metaphysics of Free Will is devoted to two major projects. First, Fischer defends the thesis that determinism is incompatible with a person's control over alternatives to the actual future. Second, Fischer defends the striking thesis that such control is not necessary for moral responsibility. This review essay examines Fischer's arguments for each thesis. Fischer's defense of the incompatibilist thesis is the most innovative to date, and I argue that his formulation restructures the free will debate. To (...) defend his second thesis Fischer relies upon examples designed to show that an agent is responsible for an unavoidable action. I criticize Fischer's account of these examples, but I also maintain that my criticisms do not compromise his theory of responsibility. I raise several other difficulties for Fischer's theory of responsibility, and I close by offering some suggestions about how he might further defend it. (shrink)

The concept of causation is fundamental to ascribing moral and legal responsibility for events. Yet the precise relationship between causation and responsibility remains unclear. This book clarifies that relationship through an analysis of the best accounts of causation in metaphysics, and a critique of the confusion in legal doctrine. The result is a powerful argument in favour of reforming the moral and legal understanding of how and why we attribute responsibility to agents.

Starting from Marr's ideas about levels of explanation, a theory of the data structures and access processes in human memory is demonstrated on 10 tasks. Functional characteristics of human memory are captured implementation-independently. Our theory generates a multidimensional task classification subsuming existing classifications such as the distinction between tasks that are implicit versus explicit, data driven versus conceptually driven, and simple associative (two-way bindings) versus higher order (threeway bindings), providing a broad basis for new experiments. The formal language clarifies the (...) binding problem in episodic memory, the role of input pathways in both episodic and semantic (lexical) memory, the importance of the input set in episodic memory, and the ubiquitous calculation of an intersection in theories of episodic and lexical access. The article explores the agreements and disagreements between the author and the authors of Responsible Brains on how neuroscience relates to moral responsibility. The agreements are fundamental: neuroscience is not the harbinger of revolutionary revision of our views of when persons are morally responsible for the harms that they cause. The disagreements are in the details of what is needed for neuroscience to be the helper of the moral sciences.

ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof.
